(Community Matters 67) Marshall Committee Working to Fast-Track Appeal

Continuing its legal effort to zero-in on actions that have, so far, prevented a referendum on construction at the Marshall (Michigan) Megasite, the Committee for Marshall- Not the Megasite is vowing an appeal.

Committee attorney, Minneapolis-based Robby Dube of Eckland and Blando, thinks there is a good chance to have the case heard by an appellate court sooner than later given the election law nature of the case. Their hope is to have an appellate decision before the August 2024 primary.

“We’re very confident in this appeal,” Dube said. “I’ve never lost an appeal.”

Circuit Judge William Marietti dismissed the remainder of an August 2023 amended complaint from the Committee, paving the way for an appeal. An attorney for MAEDA and Ford Motor Company tells Community Matters a further appeal is likely if the appellate court sides with the Committee. That would send the case to the Michigan Supreme Court.
